A pre-existing condition is usualy defined as an injury or illness for which the individual has received treatment for and has been or currently is under the care of a physician.  It is also considered to be a condition for which a reasonable person should have sought treatment. 

Many individual carriers are now offering HIPAA compliant coverage for those persons who have qualifying coverage under the Federal Law. 

Group medical plans offer a waiver of the pre-existing condition clause if the insured has had previous uninterupted comerage before coming into the group.
